Privacy Policy

We at Pison Technology, Inc. (together with its affiliates, “Pison,” “we,” “us,” or “our”) know you care about protecting your personal data, and we take your privacy seriously. This policy (“Privacy Policy”) describes how we collect, use, and share the information of individuals who access or use Pison’s website, applications, devices, hardware, software, products, and services (collectively, the “Services”).

Remember that your use of the Services is at all times subject to the Terms of Use, which incorporates this Privacy Policy. 

1. INFORMATION WE COLLECT

Information You Provide to Us. We collect information from you when you choose to provide it to us. For example:

• Account Information: When you create a Pison account, we collect basic information such as your name, email address, phone number, username, and password.
• Additional Profile Information: To enhance your experience with the Services, we may request, and you may choose to provide us with, additional information, such as your gender, ethnicity, age range, occupation, income range, interests, and a profile picture.
• Other Communications: When you request information from us, respond to forms or questionnaires, participate in surveys, or otherwise contact us, we collect communications that we exchange with you.

Information We Automatically Collect. We may use cookies, web beacons, or other technologies to automatically collect certain information when you interact with the Services. For more information about how we use cookies, and to learn how to manage your preferences, visit our Cookie Policy. Examples of the type of information collected are:

• Device Data such as your IP address, device type and version, unique identifiers, cookie information, browser type and settings, mobile device carrier, network information, and general location information such as city, state, or geographic area
• Analytics Data such as pages or screens you view, how long you spent on a page or screen, navigation paths, and how and when you log into your account or pair your Pison Device with your account. 

Information Collected through Use of the Services. Examples are:

• Pison Device Data. The Pison Device is a wearable sensor that, when used in connection with the Services, collects certain types of personal data. When the Pison Device syncs with other Pison applications or software, data recorded on the Pison Device is transmitted from your device to the Pison applications or software, and to our servers.  
• Geolocation Data such as GPS if you permit us to track your device location while you use the Services.
• Health and Activity Data may be collected or inferred from measurements taken by the Pison Device. Before collecting or processing any information that could be considered health data, you must give your explicit consent to the processing of that data by Pison. You can withdraw your consent at any time.
• User Contributions such as when you provide information to be published or displayed through publicly accessible community features.
• Payment and Transactional Data needed to complete your orders in connection with the Services, although Pison does not have access to, or store, your payment card information. Our payment processors will collect the information necessary to process your payments in accordance with their respective services agreements and privacy policies.
• Marketing Data such as your preferences for receiving marketing communications and details about your engagement with such communications.

Information Collected from Third Party Platforms. We collect information when you interact with our pages on social media, sign up and log into the Services using accounts you create with third party platforms such as Meta, Google, or Apple, or otherwise link accounts, devices, or features from third parties to your Pison account. You can generally control the information that we receive from third party platforms using the privacy controls provided to you by such third parties. 

Information Collected from Marketing and Advertising Partners. This includes companies providing us with analytics and advertising services to help us better understand how users interact with the Services, to serve advertisements on our behalf, and to measure the performance of those advertisements. 

2. HOW WE USE INFORMATION WE COLLECT

We use the information we collect as described below. 

To Deliver the Services. This includes:

• Operating and maintaining the Services in accordance with our Terms of Use 
• Improving, developing, and personalizing the Services, including troubleshooting, performing analysis and testing, and conducting research and surveys
• Providing support and assistance in connection with the Services, including creating and managing your Pison account
• Processing orders, subscriptions, and transactions
• Communicating with you about the Services

For Compliance and Protection. We use the information we collect to promote the safety and security of the Services, our users, and other parties. This may include responding to law enforcement requests, protecting against fraud or other illegal acts, complying with or enforcing our legal or contractual obligations and resolving disputes, and conducting audits.  

Research and Development. In connection with our research and development efforts, we create and use aggregated data, de-identified data, or other anonymous data from personal data we collect for our business purposes, including to analyze the effectiveness of the Services, to improve and add features to the Services, and to analyze the general behavior and characteristics of users of the Services.   

Direct Marketing and Advertising. This includes marketing and promoting the Services or other Pison products or services by sending you direct offers, marketing messages, or advertising or through push notifications, in accordance with your preferences. You can control marketing communications and notifications by accessing your account settings or via the “Unsubscribe” link in an email.   

3. SHARING OF INFORMATION WE COLLECT

We do not rent or sell your personal data. There are, however, limited circumstances in which we may share your personal data with third parties, as set forth below:

• Advisors, Consultants, and Service Providers: We, like many businesses, sometimes contract with third parties to perform certain business-related tasks and functions, such as processing payments, shipping and logistics providers, and website hosting. When we employ another entity to perform a function of this nature, we only provide them with the information that they need to perform their specific function, and they are required to protect and secure your information.
• Related Companies: We may share personal data with our corporate affiliates and subsidiaries, if any, for purposes consistent with this Privacy Policy.
• Business Transfers: We may choose to buy or sell assets. In these types of transactions, personal data may be one of the transferred assets. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, personal data could be transferred to or acquired by a third party. 
• Legal Requirements: We may disclose personal data if required to do so by law or in good faith believe that such action is necessary to comply with a legal obligation. We may also retain, preserve or disclose personal data if we determine that it is reasonably necessary or appropriate to prevent any person from death or serious bodily injury; to enforce or apply our Terms of Use; to prevent or detect fraud or abuse; or to protect our property or other legal rights, including by disclosure to our legal counsel and other consultants and third parties in connection with actual or potential litigation.
• Advertising Partners: These parties help market our business and may collect information about your use of the Services to promote Pison or display information that may be relevant to your interests on the Services.
• Other Users: You may direct us to disclose your information to others, such as when you use our community features like the forums and other social tools. 

Non-Personal Data: We may deidentify, aggregate, or anonymize data from the personal data you and others make available in connection with the Services such that you are not individually identified, and use, sell, license or share that non-personal data with third parties for research, business, or other purposes. We do not disclose non-personal data in a manner that would identify you as an individual.  

4. LINKS TO OTHER WEBSITES

The Services may contain links to other websites and online services operated by third parties, which may have privacy policies that differ from our own. In addition, our content may be integrated into web pages or other online services that are not associated with us. These links and integrations are not an endorsement of, or representation that, we are affiliated with any third party. We are not responsible for the practices of such third parties and suggest contacting such third parties directly for information on their privacy policies.

5. DATA SECURITY AND RETENTION

We have taken certain physical, organizational, administrative, and technical measures to safeguard the data and information we collect. While we endeavor to protect the integrity and security of our network and systems, we cannot guarantee the absolute security of your account or information. You should help protect your data by appropriately selecting your password, limiting access to your computer or device, and signing off after you have finished accessing your account.

We retain personal data for as long as reasonably necessary to provide you with the Services, to perform our legitimate business purposes, to comply with applicable law, and to prevent harm as described in this Privacy Policy. 

6. MANAGING YOUR SETTINGS

We provide you with account settings to access and manage your personal data, as described below, regardless of where you live. If you live in certain locations, you may have specific legal rights with respect to your personal data, which you may exercise as described in this Privacy Policy.  

• Privacy Controls: You can change certain privacy settings, including opting out of marketing related communications, limiting how your information is visible to other users of the Services, limiting notifications, and revoking the access of third party applications that your previously connected to your Pison account, by logging into your account. You can also unpair your Pison Device from your account at any time.  
• Geolocation Data: You may allow or disallow us to collect geolocation data by enabling or disabling location services on your device. If you decline to grant Pison access to this data, we will not be able to provide certain Services, capabilities, or features to you. 
• Updating Information: You can access, correct, amend or update profile or account information you’ve provided to us by logging into your account. Note that when you update information using your account settings, we may maintain a copy of the unrevised information in our records.
• Deleting Information and Accounts: You may request to delete your account and corresponding data by contacting privacy@pison.in-beta.link. Note that we may need to retain certain personal and non-personal data in our records after you update or delete it, for reasons consistent with this Privacy Policy.  

7. CHILDREN AND MINORS

If you are under the age of 13, or any higher minimum age in the jurisdiction where you reside, please do not submit or attempt to submit any personal data about yourself to us. If we learn that we have collected personal data from a child under the relevant minimum age, we will delete that information as quickly as possible.  If you have reason to believe that a child under the relevant minimum age has provided personal data to us, please contact us at privacy@pison.in-beta.link.

8. CHANGES TO THIS PRIVACY POLICY

This Privacy Policy was last updated on the date indicated above. We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time, but we will alert you to changes by placing a notice on the Pison website, by sending you an email, and/or by other means. Please note that if you’ve opted not to receive notice emails from us (or you haven’t provided us with your email address), those notices will still govern your use of the Services, and you are responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

10. PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

If you are a California resident, please review these additional privacy disclosures made pursuant to the California Consumer Privacy Act (“CCPA”). 

What Rights Do I Have and How May I Exercise Them?

California residents may have rights such as the right to understand how we collect, use, and disclose your personal information, access your information, request that we delete certain information, and to exercise these rights free from discrimination. You may exercise these rights by logging into your account as described in this Privacy Policy or by contacting us at privacy@pison.in-beta.link.  

Please note that the CCPA limits these rights by, for example, prohibiting businesses from providing certain sensitive information in response to an access request and limiting the circumstances in which they must comply with a deletion request.

Please see the Information We Collect section of this Privacy Policy.  We do not sell the personal information of our users.

11. INFORMATION FOR USERS IN EUROPE

If you are located in the European Economic Area (“EEA”), the United Kingdom, or Switzerland (collectively, “Europe”), please review these additional privacy disclosures.

What Rights Do I Have and How May I Exercise Them?

Data subjects located in Europe have the following rights with respect to their personal data:

• Access. You can access certain personal data by logging into your account as described in this Privacy Policy, or by directing requests for more information about the personal data we hold or copies of such personal data to our representatives listed below.
• Rectification. If you believe that any personal data we are holding about you is incorrect or incomplete, you can correct certain of this information by logging into your account as described in this Privacy Policy, or by directing requests that we correct or supplement such data to our representatives listed below.
• Erasure. You can request that we erase some or all of your personal data by directing requests to our representatives listed below.
• Withdrawal of Consent. If we are processing your personal data based on your consent (as indicated at the time of collection of such data), you may withdraw your consent at any time by stopping use of a feature, removing our access to a third party service, unpairing your Pison Device, or deleting your data or your account. To the extent that information we collect is considered health data or another special category of personal data, we ask for your explicit consent to process the data.
• Portability. You can ask for a copy of your personal data in a machine-readable format, and can request that we transmit the data to another controller where technically feasible, by directing such requests to our representatives listed below.
• Objection. You can contact our representatives listed below to let us know that you object to the further use or disclosure of your personal data for certain purposes, such as for direct marketing purposes.
• Restriction of processing: You can contact our representatives listed below to ask us to restrict further processing of your personal data.
• Right to file a complaint. You have the right to lodge a complaint about our practices with respect to your personal data with the supervisory authority of your country or EEA Member State.

Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law, but in those circumstances, we will still respond to notify you of such a decision. In some cases, we may also need you to provide us with additional information, which may include personal data, if necessary to verify your identity and the nature of your request.

Legal Bases for Processing

We will only process your personal data if we have a legal basis for doing so. Legal bases for processing will depend on the type of personal data and the specific context in which we process it, but include: 

• When you have given consent, which you may withdraw at any time
• When the processing is necessary to perform a contract with you, such as the Terms of Use
• Our legitimate interests or the legitimate interest of others, such as improving, personalizing, researching, and developing the Services, marketing new features or products that may be of interest, and promoting safety and security
• When necessary to comply with a legal obligation, protect the vital interests of you or other data subjects, or for a task carried out in the public interest

We may use your Personal Data for reasons not described in this Privacy Policy where permitted by law and where the reason is compatible with the purpose for which we collected it. If we need to use your Personal Data for an unrelated purpose, we will notify you and explain the applicable legal basis.

Personal Data Retention

To determine the appropriate retention period for your personal data, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

Processing Personal Data in the United States

To provide the Services, we will process your personal data in the United States, where we are based. If such processing involves the transfer of personal data to the US in a manner governed by European data protection law, the transfer will be performed pursuant to the applicable requirements of the law, such as standard contractual clauses, the individual’s consent, or other circumstances permitted by law.

 COOKIES AND SIMILAR TECHNOLOGIES

Like many businesses, we use Cookies and similar technologies such as pixel tags, web beacons, and JavaScript (collectively, “Cookies”) to enable our servers to recognize your web browser and tell us how and when you visit and use our Services, as well as to analyze trends, learn about our user base, and operate and improve our Services. Cookies are small data files placed on your browser or device. We may supplement the information we collect from you with information received from third parties, including third parties that have placed their own Cookies on your device(s).

We use the following Cookies:

• Essential Cookies: Essential Cookies are required for providing you with features or Services that you have requested. For example, certain Cookies enable you to log into secure areas of our Services. Disabling these Cookies may make certain features and Services unavailable.
• Functional Cookies: Functional Cookies are used to record your choices and settings regarding our Services, maintain your preferences over time, and recognize you when you return to our Services. These Cookies help us to personalize our content for you, greet you by name, and remember your preferences (e.g., your region).
• Performance Cookies: Performance Cookies allow us to understand how users use our Services by collecting information on how often a user engages with a particular feature of the Services. We use these aggregated statistics internally to improve the Services. Performance Cookies also help us measure the performance of our advertising campaigns in order to help us improve our campaigns and the Services’ content for those who engage with our advertising. • Marketing Cookies: Marketing Cookies collect data about your online activity and identify your interests so that we and our advertising partners can provide marketing that we believe is relevant to you. 

Interest-based advertising. We engage our advertising partners, including third party advertising companies and social media companies, to advertise our Services. We and our advertising partners may use Cookies and similar technologies to collect information about your interaction over time across the web, our communications, and other online services, and may use that information to serve online ads. We comply with the Digital Advertising Alliance Self-Regulatory Principles for Online Behavioral Advertising. Online tracking opt-outs. There are a number of ways you can opt-out of certain interest-based advertising and other online tracking activities, which we have summarized below.

• You may use your browser or device settings to clear or decline cookies 
• Check your mobile device for settings that control ads based on your interactions with the applications on your device
• You can block our websites from setting Cookies used for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party Cookies/trackers. 
• You can opt out of Google Analytics by downloading and installing the browser plug-in available at: https://tools.google.com/dlpage/gaoptout.
• Some third party ad networks, including third-party ad servers, ad agencies, ad technology vendors, and research firms, allow you to opt-out directly by using their opt-out tools. Some of these providers, and links to their opt-out tools, are:

 Please note that some opt-out features are Cookie-based, meaning that when you use these opt-out features, an “opt-out” Cookie will be placed on your computer or other device indicating that you do not want to receive interest-based advertising from certain companies. If you delete your Cookies, use a different browser, or use a different device, you will need to renew your opt-out choice. Opting-out of interest-based advertising does not mean that you will no longer receive online ads. It only means that such ads will no longer be tailored to your specific viewing habits or interests. You may continue to see ads on and about the Service.

The Services do not currently support “Do Not Track” requests or similar signals.
